Glossary of terms used for case information

Note: The purpose of these definitions is to help people understand the terms we display on My Case for case information. They are not legal definitions and should not be treated as such. If you are a client, you should consult your counsel for precise legal information.

 

Admissibility Hearing

Immigration Division

A hearing conducted by the Immigration Division to determine whether a foreign national or permanent resident is allowed to enter or remain in Canada. 

 

Adjourned – Awaiting Information

All divisions

Your hearing has been concluded and the decision-maker has requested information from one or both of the parties.

 

Appeal Filed

Immigration Appeal Division and Refugee Appeal Division

Your notice of appeal has been received and you will receive confirmation shortly.

 

Appellant's Record Received

Refugee Appeal Division

The appeal has been perfected (the filing of the appeal is complete). The other party now has the opportunity to respond to the appeal within the legislative time limit 

 

Application

All divisions   

A request that is submitted to the Immigration and Refugee Board of Canada for a decision on a preliminary matter in the file (not the final decision).

 

Application Pending

All divisions

The Immigration and Refugee Board of Canada is processing an application.

 

Awaiting Basis of Claim Form

Refugee Protection Division

You have made a refugee protection claim and we are waiting for you to submit your Basis of Claim Form.

 

Awaiting Decision

All divisions

Your file is with the decision-maker to make a final decision.

 

Awaiting Reply from Appellant

Refugee Appeal Division

A response to the appeal was received. The appellant now has the opportunity to provide a reply within the legislative time limit.

 

Case Closed

Immigration Division

The case is closed and there will be no further hearings at the Immigration Division.

 

Case Reopened

Refugee Appeal Division, Immigration Appeal Division and Refugee Protection Division

A final decision was made in your case.  However, your case has been reopened for a new decision.

 

Claim Received / No Hearing Date Set

Refugee Protection Division

We have received your refugee protection claim and will schedule a hearing as soon as possible.

 

Continued Detention Ordered

Immigration Division

The Immigration Division has ordered that the person remain in detention after a detention review.  A future detention review will be scheduled to review the reasons for detention to determine whether detention will be continued or whether the person will be released.

 

Counsel

All divisions

A counsel is an individual who represents and provides advice to a person appearing before the Immigration and Refugee Board of Canada. If a fee is being charged for their services, counsel must be a member in good standing of a professional body: a lawyer, a paralegal (currently only in Ontario), an immigration consultant, or a notary in Quebec. If a fee is not being charged, counsel can be any person, including a trusted friend or community member.

 

Decision Made

All divisions

A final decision has been made on your case. 

 

Designated Representative

All divisions

A designated representative is a person who is appointed by the Immigration and Refugee Board of Canada to represent the interests of a minor or a person who cannot understand the nature of their case.  A designated representative is a different person from counsel.

 

Detention Review

Immigration Division

A hearing held by the Immigration Division to review the reasons for detention and to determine whether detention will be continued or whether the person will be released.

 

Language of Proceeding

All divisions

The language which will be used during your proceeding.  It will be either English or French.

 

Minister's Counsel

All divisions

A person employed by the Canada Border Services Agency or Immigration, Refugees and Citizenship Canada who represents the Minister in your case and who may submit evidence, ask you and other witnesses questions and make arguments.

 

New

Immigration Division

The case is newly referred by the Canada Border Services Agency to the Immigration Division.

 

No Jurisdiction 

Immigration Division

The Immigration Division is not continuing the hearing of the case, or does not have the legal authority to hear or make a decision on a particular matter.

 

Order for Release Issued

Immigration Division

The Immigration Division has ordered the person to be released from detention and may impose any conditions that it considers necessary, including the payment of a deposit, the posting of a guarantee or compliance with the conditions.

 

Pending review and / or Scheduling

Immigration Appeal Division

The appeal record for your case has been received. The Immigration Appeal Division will review your appeal and might contact you for more information.  When it is time to schedule your hearing, you will be notified.

 

Person Concerned

Immigration Division

The permanent resident or the foreign national who is the subject of the admissibility hearing or the detention review.

 

Person Released

Immigration Division

The person concerned has been released from detention by an order issued by the Immigration Division.

 

Person Released Prior to the 48 Hour Review

Immigration Division

The person concerned has been released from detention by the Canada Border Services Agency prior to the first scheduled detention review hearing.

 

Person Removed

Immigration Division

The person concerned has been removed from Canada by the Canada Border Services Agency.

 

Private Proceeding

Immigration Appeal Division and Immigration Division

A private proceeding is not open to the public and only parties in the case are allowed into the hearing room or to access documents in the case file.

 

Removal Order Stayed

Immigration Appeal Division

The removal order made against you has been put on hold (also referred to as “stayed").  Your appeal will be reviewed at a later date as indicated in the written reasons for your stay.

 

Review Closed

Immigration Division

Your detention review case is closed at the Immigration Division. There will be no future hearing date scheduled for the case.    

 

Scheduled

All divisions

A date for your hearing or conference has been set. A Notice to Appear has been or will be sent to you with all the information you need to know about your hearing date, the time of your hearing, and the address where you need to go for your hearing. You can find the hearing date and time in the Hearing Information section of your My Case profile.

 

Suspended

Refugee Protection Division:

Your claim is not proceeding at this time. You should contact the Canada Border Services Agency for further information.

 

To Be Scheduled

All divisions

Your hearing date has been cancelled and a new date will be set at a later time, subject to current wait times and your counsel's availability.

 

Terminated

Refugee Protection Division

Your claim has been stopped by the Canada Border Services Agency and will not be heard by the Immigration and Refugee Board of Canada.

You may have a hearing date for any of the following: 

Conference, pre-hearing conference, scheduling conference, Alternate Dispute Resolution, hearing, application hearing, detention review, admissibility hearing, or abandonment conference.
